Terms of Service


These Terms set out the rights, obligations, and limitations of liability that apply when a customer accesses or uses the services of the PangoCDP platform.

1. Introduction

PangoCDP is a Customer Data Platform (CDP) for enterprises, developed and operated by ByteTech Co., Ltd. (“ByteTech”, “we”).

These Terms of Service (“Terms”) govern access to or use of the following by the customer, users authorized by the customer, and related organizations:

  • The PangoCDP website and applications
  • APIs, SDKs, and tracking code
  • Connectors and integration services
  • Related domains and technical components


2. Acceptance of the Terms

By registering an account, entering into a service contract, or accessing or using PangoCDP, the customer confirms that it has read, understood, and agreed to be bound by these Terms.

Where a user uses PangoCDP on behalf of a company or organization, the user represents that it has full authority to accept these Terms on behalf of that company or organization.

Where there is a service contract, order form, appendix, or separate agreement between ByteTech and the customer, those documents shall apply concurrently. In the event of any inconsistency, the order of precedence shall be determined by the content of the separate agreement.


3. Description of Services

PangoCDP may provide one or more of the following groups of services:

  • Storage and management of customer data.
  • Consolidation and construction of customer profiles.
  • Segmentation, analysis, and reporting of data.
  • Synchronization of data from websites, applications, and third-party systems.
  • Management of connections, accounts, and resources of third-party platforms.
  • SDKs, APIs, tracking code, and event tracking.
  • Mini Apps, forms, and technical templates.
  • Audience, journey, automation, or activation features according to the module provided.
  • Other features and services added by ByteTech from time to time.

PangoCDP is a modular platform. Services and modules may be provided independently or in combination depending on the scope licensed to each customer.

The actual scope of service for each customer depends on the contract, service package, license, configuration, and the modules activated.


4. Accounts, Organizations, and Access Rights

The customer is responsible for managing the accounts, tenants, organization, users, and access rights within its own scope.

The customer is responsible for:

  • Providing accurate and up-to-date registration information.
  • Securing accounts, passwords, tokens, API keys, and authentication information.
  • Granting access only to individuals with proper authority and a legitimate business need.
  • Revoking access when a user is no longer part of the organization or no longer needs to use the service.
  • Notifying ByteTech upon discovering unauthorized access or a security risk.

All activity arising from the customer’s account or authentication information is deemed to have been carried out by the customer, unless the customer can demonstrate that it resulted from an incident or unauthorized conduct beyond its reasonable control.


5. Permitted Scope of Use

The customer is permitted to use PangoCDP to:

  • Store and process data that is lawfully within its own control.
  • Connect to platforms and systems for which the customer has valid access rights.
  • Synchronize, manage, analyze, and exploit data in support of lawful business activities.
  • Use APIs, SDKs, connectors, and technical components in accordance with the provided documentation and limits.
  • Deploy Mini Apps, forms, tracking code, or workflows according to the customer’s configuration.

The right to use PangoCDP is a limited, non-exclusive, non-transferable right that applies only for as long as the customer is entitled to use the service.


6. Customer Responsibilities

The customer is responsible for:

  • The lawfulness, accuracy, and appropriateness of the data entered into PangoCDP.
  • The purpose for which data is used, processed, analyzed, and activated.
  • Providing privacy notices, obtaining Consent, or fulfilling equivalent obligations to end users where necessary.
  • Establishing and maintaining cookie banners, consent management, tracking consent, marketing consent, or equivalent mechanisms where required by law or by the relevant platform.
  • Access rights to the accounts, pages, Official Accounts, applications, websites, APIs, or resources connected.
  • Compliance with the law, contracts, and the policies of third-party platforms.
  • The conduct of its users, administrators, and any party authorized by the customer.
  • Retention configuration, permissions, segments, audiences, journeys, and workflows.
  • Business outcomes or decisions made based on data and reports.

ByteTech provides the platform and technical tools. The customer is the party that decides what data is entered into the system, what purpose the data is used for, and who is granted access.


7. Third-Party Platforms, Services, and Integrations

PangoCDP may support connections to Facebook, Instagram, TikTok, Zalo, Viber, Google, CRM systems, websites, applications, and other systems.

Some integrations may require the customer to complete Business Verification, App Review, OAuth Permission Approval, API Access Approval, or other approval steps specific to the platform before full use is possible.

The customer understands and agrees that third-party platforms may:

  • Change or discontinue an API, access rights, or a feature.
  • Limit quotas, rate limits, or the scope of data.
  • Revoke a token or require re-authentication.
  • Change their policies, approval processes, or technical requirements.
  • Suspend or terminate the customer’s account.

ByteTech does not control, and is not responsible for, changes, disruptions, or the independent conduct of third-party platforms. ByteTech will make reasonable efforts to update connectors where feasible but does not guarantee that every integration will remain continuously operational.


8. Data Ownership and Customer Configuration

The customer continues to own or control the data that it enters into or synchronizes onto PangoCDP.

The customer grants ByteTech a limited right to store, copy, transmit, and process data to the extent necessary to provide, protect, maintain, and support the service.

Unless otherwise agreed, the data, schemas, segments, workflows, business rules, configurations, and content created by the customer remain under the customer’s own management.

ByteTech does not assert ownership over Customer Data and does not sell, rent, or use Customer Data for ByteTech’s own independent business purposes, except where authorized by the customer or required by law.


9. Service Availability, Maintenance, and Changes

ByteTech endeavors to maintain the stability and availability of PangoCDP but does not guarantee that the service will always be error-free or uninterrupted.

The service may be affected by:

  • Scheduled or emergency maintenance.
  • Upgrades to infrastructure, applications, or security.
  • Network, cloud, power, telecommunications, or third-party platform incidents.
  • Force majeure events or conduct beyond reasonable control.
  • Technical limitations or unsuitable configuration on the customer’s side.

ByteTech may provide Beta, Preview, or Experimental features. These features may be changed, limited, or discontinued and are not covered by the default SLA, unless otherwise agreed.

Any SLA commitment, if applicable, applies only where set out in a contract or a separate appendix.


10. Intellectual Property

ByteTech and its licensors own the rights to:

  • PangoCDP and its software components.
  • Source code, APIs, SDKs, connectors, and technical libraries.
  • Documentation, interface design, icons, logos, and trademarks.
  • Algorithms, processing models, architecture, and technical know-how.
  • Updates, improvements, and features developed for the platform.

The customer’s use of PangoCDP does not transfer any of ByteTech’s intellectual property rights, except to the extent of the usage rights expressly granted in a contract.


11. Prohibited Activities

The customer must not use PangoCDP to:

  • Violate the law, privacy, or the rights of a third party.
  • Collect, store, or process data without a lawful basis.
  • Send spam, engage in fraud, or distribute harmful content or misinformation.
  • Distribute malicious code, or attack or disrupt systems.
  • Gain unauthorized access to another account, tenant, data, or infrastructure.
  • Circumvent access-control mechanisms, quotas, rate limits, or security measures.
  • Reverse engineer, decompile, copy, or unlawfully reproduce the platform.
  • Resell, lease, or resupply the service without ByteTech’s permission.
  • Share an account, token, or API key with an unauthorized party.
  • Violate the terms or policies of a connected platform.


12. Suspension and Termination of Service

ByteTech may suspend an account, connection, API, or part of the service in the following circumstances:

  • The customer breaches these Terms, its contract, or the law.
  • There is a risk to the safety of the system or data.
  • There are indications of fraud, unauthorized access, or misuse of the service.
  • The customer fails to pay in accordance with the applicable commercial agreement.
  • A third-party platform revokes or restricts access.
  • A competent authority requests it.

ByteTech will make reasonable efforts to notify the customer where practicable, except where immediate action is required to protect the system or data or to comply with a legal requirement.

The customer has the right to stop using the service within the scope, timeframe, and procedure set out in the applicable contract or service package.

Termination of service and the handling of data following termination shall be carried out in accordance with the applicable contract, the Privacy Policy, and the Data Deletion Instructions.


13. Disclaimer

Unless otherwise provided in a contract, PangoCDP is provided on an “as is” and “as available” basis.

ByteTech does not warrant that:

  • The service will be suitable for every specific purpose or business process.
  • The service will always be continuous, error-free, or uninterrupted.
  • All data, reports, or analytical results will be entirely accurate.
  • Every connector or third-party platform will always remain compatible.


14. Limitation of Liability

To the extent permitted by law and unless otherwise provided in a contract, ByteTech shall not be liable for:

  • Data or content provided by the customer.
  • The customer’s lack of Consent, rights, or legal basis.
  • Business decisions made based on data, analysis, or reports.
  • Loss of access to, or changes made by, a third-party platform.
  • Disruptions caused by cloud, network, telecommunications, or external providers.
  • Indirect damages, loss of profit, loss of opportunity, or loss of reputation.
  • Incidents arising from an account, token, or configuration managed by the customer.

Any specific limitation of liability, if applicable, shall be set out in the contract or commercial agreement between ByteTech and the customer.


15. Indemnification

To the extent permitted by law, the customer agrees to be responsible for, and to indemnify ByteTech against, any claims, damages, or costs arising from:

  • Data or content entered into the system by the customer.
  • The customer’s unlawful use of data.
  • Violation of the rights of an end user or a third party.
  • Violation of these Terms, a contract, or a third-party platform’s policies.
  • The conduct of a user or a party authorized by the customer.


16. Changes to the Service and These Terms

ByteTech may update, add to, limit, or discontinue part of a feature in order to improve the service, strengthen security, or meet technical or legal requirements.

These Terms may also be updated from time to time. The latest version will be published on PangoCDP’s website or service domain, together with the update date.

Where a change has a significant effect on the customer’s rights or obligations, ByteTech may provide notice via email, the system, or another appropriate contact channel.


17. Governing Law and Dispute Resolution

These Terms are interpreted and governed by the law of Vietnam, unless otherwise agreed in writing between ByteTech and the customer.

For customers who have entered into a separate service contract with ByteTech, the governing law and dispute resolution provisions of that contract shall take precedence.

The parties shall first seek to resolve any dispute through good-faith negotiation.
